Le changement de donne le plus important est sans doute la notion de personne en situation de handicap. Le passage de la personne handicapée à la personne en situation de handicap indique que le handicap est aussi une production sociale. Le droit à la compensation présent dans la loi de 2005 illustre parfaitement ce basculement.
